What is an “Organized Retail Theft Enterprise”

The NJ Shoplifting Law imposes enhanced penalties for those who shoplift as part of an “organized retail theft enterprise”. This term is defined as the association of two or more individuals for the purpose of effectuating the transfer of merchandise that has been shoplifted.

Grading of Charges

The degree of crime escalated under NJ law where a shoplifting involves an organized retail theft enterprise. It is a second degree offense, as opposed to the usual third degree shoplifting, whenever someone shoplifts merchandise with a value in excess of $1,000 consistent with an organized retail theft enterprise. Any other shoplift undertaken by an organized retail theft enterprise is a third degree crime even if it involves merchandise of limited value. It should also be kept in mind that for purposes of computing the value of merchandise for grading, merchandise taken by members of an organized retail theft enterprise may be aggregated.
